1.Definitions

1.1. Itemshub: Itemshub is an ecommerce platform that sells industrial products, accessories, and parts.

1.2. Purchaser: Any person that purchases through Itemshub.

1.3. Special Item: A product which is temporarily out of stock with the Itemshub suppliers and has to be ordered from the manufacturer directly.

1.4. Special Order: An order that includes special item and/or backorder item in the invoice

1.5. Back Order Item: A product which is temporarily out of stock with the Itemshub suppliers and the manufacturer. This item has to be produced by the manufacturer and then sent to Itemshub.

1.6. Ordered Items: A quantity of items purchased on Itemshub.

1.7. Click and Collect: a shopping facility whereby a customer can buy or order goods from a store's website and collect them from a local branch.

1.8. Faulty Products: an imperfection in a product that has a manufacturing or design defect.

2.1. Purchaser confirms that all images of products on Itemshub.com are for illustrative purposes only. Itemshub makes no guarantees or warrants that purchased items will be identical to depicted images.

2.2. Purchaser shall not rely on images when placing an order, and shall review full product details/description.

2.3. Itemshub shall in no way be responsible for any variation from the product image to the delivered item.

2.4. Purchaser acknowledges that items requiring/ displayed with additional accessories are sold separately, unless expressly stated otherwise. 

 3. Information accuracy and availability of Products

3.1. Items displayed may be altered, changed, and or removed at Itemshub sole discretion without prior notice.

3.2. Information displayed on Itemshub relating to availability, price and description is subject to change without prior notice. Itemshub cannot guarantee permanent or continuous availability of all products. All orders are subject to availability at all times.

3.3. All information and materials contained on Itemshub have been prepared solely for the purpose of providing general information about Itemshub and the products and (where relevant) services that are provided.

3.4. All information and materials published on Itemshub are provided in good faith as a convenience to the Purchaser and may be used for information purposes only and at all times in accordance with these Terms and Conditions.

3.5.  Purchaser acknowledges that items requiring and/or displayed with additional accessories are sold separately, unless description expressly states otherwise. 

  4.Special Item(s) / Special Order(s)

4.1. Itemshub shall use its best endeavors to show accurate inventory status for its products. Purchaser confirms that certain items may be cataloged as ‘Special Item’, and may only be purchased through ‘Special Order’ as provided for in this Clause 4.

4.2. Special Item(s) and Special Order(s) shipments may vary depending on the manufacturer or any other third party.

4.3. Purchaser acknowledges and agrees that Special Item(s) and Special Order(s) are not guaranteed to be delivered within a communicated time frame. For the avoidance of doubt, communicated delivery times are estimates only, and will only be treated as such.

4.4.   Purchaser confirms that Special Item(s) and Special Order(s) must first arrive at Itemshub warehouse from a manufacturer or other third party before being shipped to the Purchaser.

4.5. Purchaser confirms that it shall not hold Itemshub responsible, in any way shape or form, for delay in delivery caused by, or related to, late delivery by a third party, or any other reason not directly attributable to or directly caused by Itemshub.   

 5.Products

5.1. Purchaser shall use Ordered Products safely, properly, and in accordance with the general safety rules.

5.2. Purchaser acknowledges that machines and equipment have limited support lives. As such, some items and/or some parts may be discontinued for reasons, such as but not limited to, manufacturer sole discretion, Itemshub discretion, and/or government regulation, laws or directives.

5.3. Purchaser is advised that manufacturers may not have certain products in stock. As such, currently unavailable items are considered ‘Back Order Item’.

 6.Price Policy

6.1. Prices displayed on Itemshub are subject to change at any time, in Itemshub sole discretion, and without any prior notice.

7. Payment Options

7.1. Items purchased from Itemshub may be paid for by:

a) Credit Card

b) Debit Card

c) Cash of delivery for order of up to 60 Bahraini Dinars.

7.2.  Limits for payment options are inclusive of delivery charges.

7.3.  Purchaser confirms that card payments shall be processed upon placement of order.

7.4.  For cards denominated in a supported currency other than the Purchaser’s local currency, the Purchaser’s bank or card company may charge foreign conversion fees.

7.5.  Local currency displayed is an approximate exchange rate conversion, the exchange rate on Itemshub may vary from the real-time exchange rate.

 8. Order Cancellation

8.1.  Save for Special Items and Special Orders, purchased goods may be canceled by the Purchaser subject to such cancellation taking place prior to shipment of products.

8.2. Where any refund is applicable to such cancellation, Purchaser acknowledges that refund amount(s) will be returned in the payment method used.

8.3.  Itemshub may cancel orders subject to the Purchaser’s notification of such decision.

8.4.  In the unfortunate event of Itemshub canceling an order, such decision to cancel will be notified to the Purchaser through the communicated email address.

8.5.  Any amounts deducted from the Purchaser for payment of order canceled by Itemshub shall be credited to the Purchaser’s account as soon as possible, and in any event within no later than 30 days of such cancellation.

 9. Shipping and Delivery

9.1.  Items ordered shall be delivered during regular working hours of 9:00 AM to 6:00 PM, or any other communicated time frame.

9.2.  Communicated time frames are estimates, and shall not in any way shape or form bind Itemshub.

9.3.  Delivery is made through third party delivery partner(s), and as such Itemshub is not responsible for any delay in delivery, but shall use its best endeavors to assist Purchaser in resolving delivery issues.

9.4.  Multiple items ordered may not all be delivered within the same shipment.

9.5.  Purchaser confirms acceptance of multiple items ordered being delivered through multiple deliveries.

9.6.  Delivery estimates are based on quantity available for shipping at the time of receiving the order. Back Order Items and items available with only partial quantities shall be shipped through multiple deliveries upon availability. 

9.7.  Shipping fees and delivery charges shall depend on the total quantity of items, weight, and shipping speed selected.

10. Click and Collect Service

10.1. Purchaser wishing to collect their purchased products from the trade counter must do so within 2 working days of arranging collection. Failure to collect purchased items shall result in a restocking fee of 5% of the purchase price.

10.2. Purchaser acknowledges that Click and Collect Service requires the Purchaser to submit proof of identity and payment receipt when collecting purchased items from the trade counter.

10.3. Purchasers availing of the Click and Collect service shall make payment upon placement of orders.

10.4 .Purchasers confirm and acknowledge that the ‘cash on delivery’ option is not applicable for Click and Collect services.    

 11.Faulty Goods

11.1. Purchaser must notify Itemshub within [insert time frame] of receipt of ordered item(s) suffering from any fault.

11.2.   Itemshub may request Purchaser to return item(s) for testing and fault investigation purposes. Itemshub may, in its sole discretion, deem such item(s) as ‘Faulty Products’. 

11.3. Itemshub may, in its sole discretion, return, issue a refund, replacement, or repair items it deems as Faulty Products. 

12.Refund

12.1.Faulty Products may, in Itemshub sole discretion, be refunded to Purchaser in accordance with this refund policy.

12.2.Refunds will be processed using the same method of payment utilized upon purchase.

13. Warranty

13.1. Itemshub will endeavor to transfer to the Purchaser the benefit of any warranty or guarantee given by the manufacturer of Goods. Not all Goods are supplied with a manufacturer's guarantee and guarantees which may be provided by manufacturers will vary in duration. It is the Purchaser’s responsibility to check at the time of purchase as to the applicability of the guarantee and/or the terms of any manufacturer's guarantee. Where Itemshub’s guarantee is provided, then it shall, free of charge, repair or, at its sole discretion, replace Ordered Items or, in the case of Services, re-perform Services which are proved to the reasonable satisfaction of Itemshub to be damaged or defective due to faulty materials, workmanship or design. If the Ordered Items are found by Itemshub not to be damaged or defective then Itemshub will be entitled to return the Ordered Items to the Purchaser at the Purchaser’s sole expense. Software programs are supplied on the strict understanding that Itemshub does not warrant their function to be free from defects or error.

13.2 .Ordered Items shall be subject to manufacturer warranties, where available and applicable.

14.Marketing

14.1. Itemshub may send the Purchaser information about the products and services offered which may interest the Purchaser.

14.2. The Purchaser may opt out of receiving such marketing material at any time. If the Purchaser no longer wishes to be contacted for marketing purposes, the Purchaser shall inform Itemshub on the designated email address.

15.Product Review

15.1. Itemshub is neither responsible for, nor does it endorse, the content of any product review or statement posted. Any statements posted constitute the statements of the poster and are not the statements of Itemshub. Itemshub makes no representations as to the appropriateness, accuracy, completeness, correctness, correctness, suitability, or validity of any product review or statements posted.

15.2. By posting reviews of Ordered Items, the Purchaser confirms that:

1.       It is the sole author and owner of the intellectual property rights thereto;

2.       All "moral rights" that you may have in such content have been voluntarily waived by you

15.3.  Purchaser further agrees and warrants that it shall not submit any content:

1.    That is known to be false, inaccurate or misleading;

2.    That infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;     

16.Indemnity

16.1. Purchaser shall indemnify and hold harmless Itemshub, its officers, directors, employees, agents and shareholders from and against any costs, damages or other expenses that are payable (including costs of litigation and reasonable attorneys' fees) arising out of any claims by Purchaser or any third party relating to services, products, Special Item, Special Order (for the purpose of this Clause 6 referred to as Ordered Items), including but not limited to infringements on any copyright, patent, trademark, trade secret, or other intellectual property right, or use of Ordered Items for illegal or prohibited purposes, or damages arising out of or attributable to improper use of Ordered Items.

16.2. The Purchaser shall indemnify Itemshub for any losses resulting from gross negligence, recklessness, improper use of Ordered Items on the Purchaser’s part.

17. Privacy policy

17.1. All content submitted by the Purchaser may be used at Itemshub’s sole discretion. Itemshub reserves the right to change, condense or delete any content on Itemshub’s website, including content that Itemshub deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. Itemshub does not guarantee that you will have any recourse through Itemshub to edit or delete any content you have submitted. Ratings and written comments are generally posted within two to four business days. However, Itemshub reserves the right to remove or to refuse to post any submission for any reason.

17.2. Purchaser acknowledges that Itemshub is not responsible and that the Purchaser is solely responsible for the contents of any submission. None of the content that the Purchaser submits shall be subject to any obligation of confidence on the part of Itemshub, its agents, subsidiaries, affiliates, partners or third-party service providers and their respective directors, officers and employees.

17.3.By submitting the Purchaser’s email address in connection with rating and review, the Purchaser agrees that Itemshub and its third party service providers may use the email address to contact Purchaser about the status and/or subject of the review and for any other purposes, including marketing purposes. 

18. Miscellaneous

18.1. Words importing the singular include the plural and vice versa and a gender includes every other gender.

18.2. headings are inserted for guidance only and do not affect the interpretation of these Terms and Conditions

18.3. These Terms and Conditions are entered into in the Kingdom of Bahrain, and any dispute arising out of or in connection to these Terms and Conditions shall be referred to and resolved by the       competent courts of the Kingdom of Bahrain.
